These Terms of Service govern your access to and use of nightmapp. By creating an account, logging in, or using nightmapp, you agree to these Terms.
1. Eligibility
nightmapp is intended for adults. You must be at least 18 years old or the age of legal majority in your location, whichever is higher, to use nightmapp. You are responsible for complying with laws that apply to you, including laws related to nightlife venues, alcohol, travel, safety, and communications.
2. Your account
You are responsible for your account, credentials, devices, and activity. Keep your login information secure. Do not share your account, impersonate anyone, use misleading profile information, or create accounts to evade moderation. Tell us promptly if you believe your account has been compromised.
3. Apple Sign In and email login
nightmapp may allow login through email/password, verification codes, Apple Sign In, or other supported methods. You authorize us to verify identity tokens and use the account information provided by authentication providers to create, secure, or link your account.
4. The service
nightmapp helps users discover venues, save favorites, view maps, submit reports, create or join plans, invite friends, send messages, create group chats, share images, and receive notifications. Features may change, be removed, be limited, or become unavailable at any time.
5. Plans, invites, and shared links
Plan invites and external share links may allow other people to preview or join a plan. Anyone with a valid share link may be able to open the invite screen. Do not share links with people you do not want to invite. Plans may expire, be removed, or become unavailable. Joining a plan may make your profile visible to other plan participants.
6. Location, venues, and recommendations
Venue information, map data, opening hours, ratings, categories, recommendations, popularity signals, friend heat, and reports may be incomplete, outdated, inaccurate, delayed, or unavailable. nightmapp does not guarantee that any venue is open, safe, suitable, legal for you to enter, or as described. You are responsible for your own decisions, travel, safety, and compliance with venue rules and local law.
7. User content
User content includes profile information, photos, voice notes, messages, reports, comments, venue submissions, plan activity, likes, votes, names, and any other content you provide. You keep ownership of your content, but you grant nightmapp a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for formatting, display, transmit, distribute, and use your content to operate, improve, protect, and promote nightmapp.
8. Content rules
You agree not to post, upload, send, or encourage content or activity that:
- is illegal, harmful, threatening, harassing, hateful, abusive, exploitative, or discriminatory;
- targets people based on protected characteristics;
- contains sexual exploitation, non-consensual intimate content, or content involving minors;
- contains spam, scams, malware, phishing, or deceptive links;
- violates privacy, publicity, intellectual property, or other rights;
- encourages violence, self-harm, dangerous behavior, or unlawful activity;
- misrepresents venue conditions, reports, identity, location, or affiliation;
- interferes with moderation, safety tools, or other users' experience.
9. Messaging and social conduct
Do not harass, threaten, stalk, spam, or pressure other users. Respect blocks, removals, rejections, and unanswered messages. Group chat names, images, and messages must follow these Terms. We may review reported messages or accounts to enforce safety rules.
10. Venue reports and submissions
Venue reports and submissions should be truthful, relevant, and based on your genuine experience. Do not submit fake venues, false crowd reports, misleading photos, private information, or content that infringes rights. Admin approval of a venue does not mean nightmapp endorses the venue.
11. Prohibited technical activity
You may not scrape, crawl, reverse engineer, attack, overload, bypass rate limits, probe security, access non-public systems, use automated accounts, interfere with APIs, or use nightmapp to build a competing service without permission. You may not attempt to bypass authentication, authorization, geofencing, moderation, or plan access controls.
12. Safety
nightmapp is not an emergency service. If you are in danger, contact local emergency services. Meeting people, going out, visiting venues, drinking alcohol, traveling, or sharing your location can involve risk. Use judgment, meet in public places, follow local laws, and make safety plans.
13. Notifications
By enabling notifications, you agree that nightmapp may send push notifications related to messages, plans, invites, friend requests, Who's out? requests, account security, moderation, and app activity. You can disable notifications in device settings and manage categories in the app where available.
14. Moderation and enforcement
We may remove content, reject venue submissions, limit features, revoke invites, disable share links, suspend accounts, terminate accounts, preserve evidence, or report activity to appropriate parties if we believe these Terms, policies, user safety, law, or service integrity require it. We are not obligated to monitor all content.
15. Third-party services
nightmapp uses third-party services such as maps, places, login, email, push notifications, hosting, storage, and crash monitoring. Third-party services may have their own terms and privacy policies. We are not responsible for third-party websites, venues, services, or content.
16. Intellectual property
nightmapp, the nightmapp name, designs, software, logos, interfaces, and related materials are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from nightmapp except as allowed by law or with written permission.
17. Feedback
If you send ideas, feedback, or suggestions, you allow us to use them without restriction or compensation.
18. Account deletion and termination
You may stop using nightmapp or delete your account where available. We may suspend or terminate access if you violate these Terms, create risk, or use nightmapp unlawfully. Some terms will continue after termination, including provisions related to user content licenses, safety, intellectual property, disclaimers, limits of liability, and disputes.
19. Disclaimers
nightmapp is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and safety. We do not warrant that nightmapp will be uninterrupted, secure, error-free, or that venue or user information will be accurate.
20. Limitation of liability
To the maximum extent permitted by law, nightmapp and its team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, venue incidents, user conduct, or third-party services. Our total liability for any claim related to nightmapp will not exceed the greater of the amount you paid us to use nightmapp in the 12 months before the claim or EUR 100.
21. Indemnity
You agree to defend, indemnify, and hold nightmapp and its team harmless from claims, damages, losses, liabilities, costs, and expenses arising from your use of nightmapp, your content, your violation of these Terms, or your violation of law or third-party rights.
22. Changes to nightmapp or these Terms
We may update nightmapp and these Terms from time to time. If changes are material, we will provide reasonable notice where appropriate. Continued use after changes means you accept the updated Terms.
23. Governing law and disputes
Unless mandatory local law says otherwise, these Terms are governed by the laws of Hungary, without regard to conflict-of-law rules. Courts located in Hungary will have jurisdiction, except where consumer protection laws give you additional rights in your country of residence.
